Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Formation, operated by Rahul Krishna K A, an individual based in Kochi, India (“Formation”, “we”, “us”), governing your use of the Formation mobile app and related services (the “Service”). By using the Service you accept these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, hold a valid driving or riding licence where one is required for your use, and have the legal capacity to enter into these Terms. The Service is intended for use by licensed drivers and riders coordinating group trips.

2. The Service

Formation lets a group create or join a trip, share live location on a common map, send hands-free status alerts, and view trip information. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use, subject to these Terms.

3. Accounts

You sign in through Google or Apple. You are responsible for keeping your account secure and for activity under it, and you agree to provide accurate information. We may suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to:

  • misuse other members’ location data, or stalk, harass, or track anyone without their knowledge;
  • share another person’s location obtained through the Service outside the Service;
  • use the Service to facilitate dangerous or unlawful driving;
  • reverse engineer, scrape, overload, or interfere with the Service;
  • use the Service for any unlawful purpose.

5. Safety: please read carefully

Do not interact with the app while operating a vehicle. Stop safely before viewing the map or changing settings.

  • Formation is a coordination aid, not a substitute for safe driving, attention to the road, or compliance with traffic laws.
  • Location and other data may be delayed, inaccurate, incomplete, or unavailable because of GPS, network, device, or third-party conditions. Do not rely on it for navigation or safety-critical decisions.
  • You are solely responsible for your own driving and for obeying all laws, including those on mobile-device use while driving.

To the maximum extent permitted by law, we are not liable for accidents, injury, getting lost, or any decision made based on the Service.

6. Subscriptions, passes & billing

  • Formation offers a Pro subscription (recurring) and a per-trip Pro pass (a one-time, non-renewing purchase). Prices are shown at the point of purchase.
  • The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Manage or cancel your subscription in your App Store or Google Play account settings, not within Formation. Deleting the app does not cancel a subscription.
  • Payments are processed by Apple or Google, and refunds are handled by them under their policies.
  • We may change prices; changes apply to future billing periods and, where required, with notice.

7. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any warranty of accuracy, availability, uninterrupted operation, or fitness for a particular purpose. We do not warrant the accuracy or availability of location data.

8. Limitation of liability

To the maximum extent permitted by law, Formation will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any interactions between users. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including under Indian consumer-protection law.

9. Indemnification

You agree to indemnify and hold Formation harmless from claims arising out of your misuse of the Service or your violation of these Terms or any law.

10. Third-party services

The Service relies on third parties (including Apple, Google, Mapbox, and Clerk), whose own terms and policies apply to their parts of the experience. Where you access the Service through Apple’s App Store, Apple is a third-party beneficiary of these Terms and is not responsible for the app or any support or claims relating to it.

11. Intellectual property

Formation and its content are owned by us and our licensors. You retain your own trip and route data, and you grant us the licence needed to operate and provide the Service to you and your trip members.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms. Subscriptions billed by Apple or Google are not refunded by us except through their platforms.

13. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at Kochi, India have jurisdiction over disputes. Nothing here removes any right you have to approach a consumer forum under Indian law.

14. Changes & contact

We may update these Terms; we will post the new version with a revised “Last updated” date and, for material changes, notify you. Questions: hello@getformation.in.
